You can file but it doesn’t guarantee you will get approved. You must state your case telling what happened and your employer has to also show good cause as to why they fired you.
Most companies will deny the claim but you can appeal if they do and still win. You have to justify your claim.
Depends on why you were fired. I know people that have been fired and some got unemployment and some were denied. All depends on what happened.
Hard to say without providing more information…assuming you didn’t do something wrongful to get terminated you should have a chance.
normally people don’t receive unemployment if they got fired. if it was a wrongful termination then you might be able to clear your name and collect unemployment.
if not start searching the job listings!
You can be denied for reasons like stealing etc, but just because you are fire doesn’t mean you are automatically ineligible to collect.

88 miles to 119 mile round trip daily. R.I. employment law requires me to travel 70 miles round

I worked for the dept of corrections. I have a good friend thats incarcerated. we wrote each other all the time, like pen pals. My friend needed some support, thats all. I was terminated because I didnt get permission from my job to write my friend. My father, mother and alot of family members were incarcerated before. See they moved me to third from first and I’m a single parent of two, I had to call in the first two days because I couldn’t find a baby sitter . when i went back they said I had 11 points and was issued a 3 day suspension which was my second of the year. To point out you have to have 13 points so can they fire me for getting another 3 day suspension.

I was fired from missing my training day. I came in on last day of orientation when I was given days of training (which was a shift that I was not offered). I was offered third shift and took it thinking my training would be on third. my company is going to independent contractors which means we will be responsible for paying our own fed taxes,social security and all other taxes plus will no longer be paying milage and we are responsible for liability ins also they will be giving no raises to compensate for this and we are required to sign a new contract with them also in order to keep the job i have now i need to be cna recertified and the classes range from $500-$800 and we must pay there are no grants available for help and we have less than 30 days to do this if we dont sign the contract will we be eligible to draw unemployment

The story goes I was treated by another co-worker she put both arms out wide so i may not pass by I try to go around her both sides and hen she chest bumps me and says” DO YOU GOT A PROBLEM WITH ME? T___ phones the owners and in the mean time the LADY who treated me writes down on a piece of paper that she is quiting, she walks pass me and says I hope you happy I just quit. The owner comes in at 8;30am she walks in middle and points at me ans says give you tickets to ******** and follow me NOW, we go to the back of the rest/side by the kitchen wlkway mind you the whole rest can HEAR evey word she is saying to me, because she is screaming at the TOP of her LUNGS she wouldn’t even let me tell my side of the story she just listened to the other LADY SIDE and told me to clock out and phone back at 3pm and they would let me know whats going on , I phone at 3pm and the Owner says we covered your shift Phone me at 10am Friday and I will tell you our decession I phoned and they didn’t give me a clear reason for letting me go I beged for my job and told then I $51 dollars to name until I get another job, I have no Family Or friends to help don’t fire give me a chance to resolve the issue at hand.

I just quit my job. Was there for 1 1/2 year. Commuting time was 1 hr a day. My car broke down a few times and I spend basically all my money trying to fix it now I can’t even buy another one, public transportation requires 3 hours on the bus and 1 hr walking, that is 4 hrs daily just commuting to work on a good day (weather don’t really help here in Upstate NY) meaning I would have to leave the house even before my kids head to school and returning home close to 9pm. I was fired after working for an insurance company for 4 months. I moved to be clsoer to the job. I am now without a job, no friends or family close. I was told it was determined that I had excessive absenteeism. All my absenses were excused, most due to falls on the ice. This company had hired a nurse who had previously worked in my position. I worked for a company who worked with mentally retarded individuals. I was accused of not doing my job on several occasions by my supervisor and the HR woman. I was suppose to wake them up to use the bathroom at night, and did. Even though I did this, 1 or 2 of them would be wet when they were woken up in the am. I was accused repeatedly of not doing this, and was written up then fired without any proof other than a co worker’s opinion on the amount of urine present. I say that because the supervisors main point is that they think i could not have woken them up at all for how wet they are.

If you can prove you had the sick time and you did not make a habbit of calling in..Also if you called in more then two hours before your shift.It would help if you could get some people to write a letter if some employees get away with it on a regular basies.Also if you have never been written for that you should win

I have been a my job for 21/2 years and worked up to be a crew leader and was an outstanding employee. I was sick and did not call in. I went in the next day and was fired. My boss didn’t even offer to give me a probationary period like we did with others there. I asked if my boss would consider having me back and putting me on a probationary period and he said no. I have been working for a facility for almost 5 years. I am high on the senority chain and believe I gave excellant care. Under and assistant manager who has had it in for me for the past several months, having me wrote up whether it be verbally or an actual write up. I worked for Dept. of corrections for 4 yrs in dc, I had a stroke last year returned towork after 2 months, worked for 9 months to be falsley accused of trying to bring contraband a cigarett into the facility by the Captain on duty for that shift to be terminated that monday.with no evidence of me having any contraband. the check in officer even wrote a statement of me not having contraband on me but was still terminated because of this false accusation. i applied for benefits in DC but was denied because of this statement, which left me with no income to provide for me and my daughter. is there anything i can do?
Even if you are fired, an especially for no valuable reason, even after a short you can file for unemployment, but since the employer does not want to pay, have to take legal action.

To work on the mercy of an unable and incompetent Supervisor no one should loose his job, if so, the Supervisor has to be blamed, he is not able to train and inform his employee.

I am a marketing manager at a finaicial institution. I have been with the Bank for over 5 years earning “Top Performer” status in 2007. The leadership here has decided to farm out the Bank’s marketing to outside firms. They don’t want to fire me, so they’ve asked me to take a Branch Manager position (probably same pay). I not at all qualified for this position. I have not specific training as a Branch Manager or eduction (they usually have finance degrees). I have been eductated as a marketer and have over 12 years of experience marketing at different companys. MY QUESTION IS: If i refuse to take the Branch Manager position and they fire me, can I collect unemployment?
I’ve worked at my job for 2and a half years. I have only one write up for working off the clock. My manager went on vacation for the first time in 3years. My assistant manager didn’t know how to check in orders. my boss said to make sure I check them in. I said what if the assistant won’t let me. Cause only management is allowed to do this. I have been working for the same company for 4.5 years now. I have been an excellent employee always making sure my managers know I am willing to do any task they want to throw my way…The past year has been very rough on me with my health in fears I may have cancer. I was a devoted hard working colleague who started as a now responsible for managing approx 49 colleagues. I was labeled as this “witch”…. And I am sure that at times this was true to an extent. However i followed what i was taught as procedures and policies.. Anyways it was a night in Jan of this year and I was not feeling well and i contacted my “point person” and had her contact our “hr” person to see if it was possible that i get vacation for the remaining 8 hours of the day. The next day i was informed that i was being suspended upon investagation of “theft”. I was floored and was very upset.. I had been with this company for 5 1/2 years and started from the ground….I was not there when this incident happenned and i was not involved… Anyways this could go on forever but the other 3 colleagues were terninated for the same reason and the same day and they all got their unemployment on the first try and i am now appealing this. Why was I denied???? I need that earned money for my family and my bills… There was no admission of guilt, there was no video as they claim they had there was nothing but he said she said and the head of hr informed me that he was dissopinnted that i had no idea that this was happenning… HELP ME
When this happens what does the employer have to have to prove this? What happens when this is not true and you keep saying this but you were denied of your unemployment benifits. There is no proof. There is not video showing this as they claim. There is no admission of guilt. What can you do to prove that you are telling the truth and that you did not take anything? What approach should you take on your phone hearing? Is it a positive thing when you contact the lawyers that unemployment provides and they want to take the case and they say they believe you ( of course they already have your file that you sent them)? I just don’t want to get over exicted thinking that i am going to get the back pay that is due and earned to me?..I have over due bills just like everyone else?

I was fired from a job I loved because the manager was a total lunatic who was going through her change . She even had me move the new manager in to an apartment (i was an apt manager) and I didnt even know it. I even caught on, since they said it was okay for her to be in a senior facility. I said please give me documentation for the file..I was given a nasty email saying WE said it was okay..blah blah..I repeatly asked to take PTO time off I earned, and was denied. 38 hrs they took from me that I earned. I filed a complaint with the state of MI to get it..we’ll see how that goes. I filed for unemployment, but have to wait 6 weeks. I guess my advice is to keep all emails, document everything..I knew she would pull some kind of stunt eventually, so I did just that. If they deny me my unemployment, I am prepared for a fight. Also, during this waiting time, keep calling the unemployment office when youre supposed to (once every other week) because when or if youre approved for it, they will back pay you those weeks. I am simply disgusted on how employers these days in this economic hardship think they can yell and scream, and treat employees like dirt because they know they can easily be replaced by the millions of people who are unemployed. I wish there was some kind of committee (and maybe there is, I simply havent found it yet) that fight for the rights of employees being abused day after day by nutcase management. After I was fired, I felt such a relief..like the abuse was over, finally. Abuse is a strong word, but thats exactly how I felt. I pray I am never in that situation again. Good Luck to all.

All you can do is try. Most states are employee friendly. Look up on your state website (wages and employmemt something or other) to find the form where you can fight for them to pay you youre PTO. Thats what I did, still waiting to find out.

i had once work in the temp job i was one of the best worker in the whole place. work was assemlyline work. i had work with this job for 3 years off and on. one day i had work on a good line and my friend was on really bad line and all of them was going to get send home. then they had took the best worker off the the line and change the person with me and it seem like they had step me up, they were treating us wrong. so i had to leave the job and had got fired.
I worked at both UPS and Fedex part-time for approx a year. Upon hiring me at Fedex, the manager knew that i was currently employed by UPS. So now I probably have to suffer the consequences. I was laid off back in Sept 2009 from big telecommunications company. I’ve been on unemployment since then but I worked a temporary job out of town from Jan ’10-April ’10. I blame myself and I feel so stupid because I listened to really bad advice. I was told when I file my unemployment every week that the questions I answer pertain to the state I reside in and not the state I was temporary visiting and temping a job in. I take full responsibility for my stupid mistake. Now, the unemployment office has scheduled a phone hearing because I voluntary quit the temporary job. My residence is in Northern Virginia and I went to visit my elderly parents in Hawaii. They needed my help, so I went there to help them and then I got a temp job and then I came back home to Virginia. What do I say to them? Do I admit I made a mistake? As of this moment I am not working. I will be up the creek if they stop my unemployment benefits. What was I thinking? Of course that person and I are no longer friends and she works in HR!

YES, in some case’s you can get unemployment after being fired. When you apply for unemployment they will ask you how you lost your job (laided off, fired, quit). I was fired for not filling out a proper form (total BS). After filing for unemployment, they sent me a letter saying that my unemployment claim was under review, and they set up a over the phone interview with me, asked me how I got fired and what were the circustances behind it. They found in my favor, (my company couldn’t prove that I did or did not fill out this certain “form”, because of bad record keeping) and I was sent my unemployment check within the next few days

You can still get unemployment providing you were fired through no fault of your own, (example – You cant keep up with your workflow and they let you go because you dont meet there standards.) I dealt with this situation and though it takes time for the EDD they just need the facts. Remember its not the individual who is making it hard, its the system. Be honest with them and you will have done the best you can do.
I was fired because I gave a custamer too much of a discount. I had worked at this retail beach store for 14 years. I was at one time made manager and had a key to the store because they trusted me. I was good at what I did and every one liked me. I worked hard and never missed work unless I was to sick to get out of bed. Kids were not getting to school or daycare and now it wont let me file for my unemployment. I NEED THE MONEY RIGHT NOW. please dont stop my unemployment yet.

If you were hired and he new your situation from the geck go and you now explained to him due to the fact i have children at home these new hrs are not working /don’t quite, try calling labor enforcement/unemployment and let them handle it. I am currently in the same position but I watch my twin grandchildren and they switch my hrs too. I consider it discrimination on the job. Good Luck .

I worked for this company for 3 years and yesterday I’ got my days cut off. When I asked manager why she told me that she is not satisfy with my customer service ( she never had anybody complain about me, all secret shoper test I;ve past with 100% score) . She directly said to me that she doesnt want me to work in her unit. I know she would keep bag me all the time from now on. If I get fired can I still recieved an unemployment.

I worked for a company for 24 Years Plus-it changed owners at least four times in the entire time that I was employed there. In order to not have to pay the “old” employees what they were making, they took a regular employee to watch over your shoulder, and say “you’re doing it wrong, and then you would get written up!After three consecutive write-ups, you were fired.They wrote it up as misconduct,and I was terminated. I was also denied unemployment. Will I ever be able to collect on those twenty four years of sevice, or am I up the creek?
I work for 3 years and I was training people and I found out that the guy was making more money than me. I ask for a raise but he did not give it to me so I quit. He would get me in front of people and ask a question and when I did not know the answer he would say I should not have ask you because you do not know the answer he would call his employees stupid in front of his patients that is no way to treat your employees. So i’ve been at my job for 3 years. My co-worker came back to work after i’d been there for a few months. She’s quit and left and then came back like 3 times since i’ve been there. she always gets all the best hours. I was working a closing shift at my job one night when the manager had another co-worker come and get me and tell me to go into the office where the manager was standing and a paper on the desk. I ask “what is this about” the manager just said “read it” as she was doing other things. I read it and she had written me up for just nonsense and blaming me for things I did not do. i worked for my company for 4 years……got a transfer to a different job location but with the same…they tried to make me a bar tender..i told them no..they investigate to find out why…..i have felony charges.. I told them myself… then all of a sudden …i had to be fired because i cant work for the company according to stae law with a felony..so what about the three years i did work for them with the same felony… I admitted i was a good girl gone bad. but quickly for the right path…and i still get it thrown in my face eveyday!!!! now how can i win …..when the system is design to continue to make me a loser…though i know that is not who i am.. everyone..KEEP YOUR HEAD UP!!

I have worked at a call center for over 3years. They have amonthly sales quota that you must meet, no matter how many consecutive months you meet quota the first time you miss they give you a verbal warning if you miss the next they give you a written warning the third they then tell you you will be fired if you miss the next month. I have always been above the average on sales vs calls recieved compared to the outher employees. In fact was given a raise on my base salary and told I wasd doing a very good job at the end of 2010. I have now missed the quota 2 months in a row, one month I missed by one sale and the 2nd month by 3 sales. The pressure is on now and can I draw unemployment if I miss quota again and am fired? I never miss work and I am never late except illness and I always have provided doctor’s statements if that happens.

i have been working for the same company for 3 and a half years and i have worked with alot of black people i got fired because the black people over ruled the white people and they were all young girls. i got into a conflict with one of the girls and they called the boss and i called the girl a bi*** and the boss thought i was talking to her so she fired me. even though she was on the phone and didnt even know what was going on she never came in to resolve any problems or did she come in to replace any of her people if she was needed.

was in a car accident about a month ago dr said to return to work but no heavy lifting then i went for futher testin on arm and dr wanted a mri and sent me back to work with limited use of right arm no heavy lifting and no heavy pushin and pulling. well they have had me workin in house keepin instead of doin the floor which involves heavy machinery and boss lady called and said i could come back to work until i get a full release from dr and she couldnt put me in house keepin either cause it said i couldnt use my right arm and thats when i told her that it said limited use of right arm and i have been workin a full month without any complaints. can i draw unemployment or would this even be considered being laid off. feel that they could have put me in house keeping or something. she know i need to work. what do i do.
